Application fee is applied to criminal background, credit screening, rental history check and
income verification costs. The application fee is non-refundable once it has been submitted to
our screening company. If your application is incomplete, it will not be submitted to the
screening company and will not be in line for the apartment. Application fees are not refunded
for denied applications.
Please note: There may be multiple applications submitted for the same apartment when you
submit your application. We will only run 1 application at a time on a first come first served
basis. Incomplete applications will not be submitted for screening. Application fees are
refundable if the application is incomplete and not submitted for screening.
Contents of the application are compared to the screening criteria by Owner/Agent and the
individual is either approved or denied in compliance with all local, state and federal laws.
Individuals are welcome to provide supplemental evidence to mitigate potentially negative
screening results. Individuals have 14 days to appeal denied applications, during which time
they may correct, refute, or explain negative information forming the basis for the denial.
Onyx Management Group Residential Rental Criteria:
Occupancy Policy
Occupancy is based on a number of factors, including size of the unit, number of
bedrooms, local ordinances and state/federal law. We have adopted a reasonable
occupancy policy which is:
Two (2) persons are allowed per bedroom plus one (1) additional person if that person is
under the age of 18 and living with legal guardian.
General Statements
All Applicants who will be signing the lease as a leaseholder and be financially responsible
for all obligations must complete an application so as to be screeded for credit and
background.
A Separate and fully completed application is required for any individual eighteen (18)
years of age or older who will reside in the unit. Co-signer’s must complete an application
and be screened for credit.
Each applicant, proposed occupant and applicable co signer will be required to qualify
individually or as per specific criteria areas.
All applicants must complete in full the rental application and pay the application fee. This is
not a promise of approval, and all applicants are subject to criteria. (APPLICATION FEE
MUST BE PAID PRIOR TO BEGINNING PROCESSING OF APPLICATION.)
Inaccurate, incomplete, or falsified information will be grounds for denial of the application.
False information on the application will result in automatic denial and will result in
automatic rejection of any application at any of our properties for a period of 6 months.
Credit screening
All applicants and cosigners/guarantors are subject to credit screening and credit score
will be used in determining results of application.
Negative information provided by a consumer credit agency indicating past due, unpaid
obligations more than $1000 but less than $5000 will be required to pay an additional
security deposit of one month’s rent for risk factors. Total deposit will not exceed 3 times
the stated rent.
Any negative credit information over $5000 will be grounds for denial.
Applicants in active bankruptcy will not be accepted. Applicants with prior records of
bankruptcy are subject to rejection, but may be accepted based on screening results,
credit score, and time since filing. Bankruptcy history will require an additional security
deposit for risk factors in the amount of one month’s rent. Total deposit will not exceed 3
times the stated rent.
Income Criteria
Applicants must have verifiable current employment and/or income with a combined
household gross monthly income of at least two and a half (2.5) times the stated monthly
rental rate for a minimum of 12 months for standard approval. If applicants have
verifiable income in excess of 2.5 times the stated monthly rent for less than 12 months
but more than 6 months, one month’s rent security deposit will be required. If Income is
less than 6 months security deposit will be increased by 1.5 times the monthly stated
rent.
If the applicant is self-employed, they must provide a copy of the previous year’s tax
return as proof of income proving at least (2.5) times the advertised rental rate monthly
for the previous year AND bank statements for the previous 6 months proving deposits
from the same income source in the amount of at least (2.5) times the advertised rental
rate.
A verifiable offer letter of employment with company/supervisor info, wages, hours, start
date etc. can be used however, security deposit will be 1.5 times the monthly stated rent
and must be verifiable.
Applicants failing to qualify under this section may be approved with a qualified cosigner.
Cosigner must qualify under all criteria and have documented income in the amount of 4
times the stated rent for a minimum of 1 year.
Rental History Criteria
Verifiable contractual rental history from a current unrelated, third-party landlord, or
home ownership of twelve (12) months or more is required for standard deposit.
First time renters or applicants failing to qualify under this section may be approved with
an additional security deposit of 1 month’s rent OR a qualified cosigner. Cosigner must
qualify under all criteria and have documented income in the amount of 4 times the
stated rent for a minimum of 1 year.
Eviction Rental History
Eviction judgment for possession and/or monetary damages against the applicant within
the last five (5) years is an automatic denial of application.
Security Deposits
A standard security deposit is the same for all approved applicants. Standard
security deposit is $500. If application is not approved due to risk factors identified in
screening, additional deposits may be necessary. Security deposits will be due at
time of signing, prior to move in. Total security deposits will not exceed 3 times the
stated rent. (see below for pet deposits)
Pet Policy
Pets are not allowed unless approved in advance by management via execution of an
approved pet addendum, which will require applicant to pay appropriate fees and
deposits. All pets must be disclosed on application and approval will be provided-
subject to execution of an addendum- so long as the pet doesn’t violate any of the below
criteria. An additional refundable pet security deposit will be due at lease signing ($300
per pet refundable).
Monthly pet rent of $25 per pet, per month will be due, beginning at move in.
Pit bull, Doberman Rottweiler, German Shepherd, etc.
This list is not exhaustive, all pets must be approved by management.
Criminal Criteria
Onyx Management Group or its affiliates will obtain a consumer credit report and/or background
check, including criminal, sex offender and rental history for each applicant to determine
eligibility. This report must be generated by a third-party provider and not the applicant.
Applicants with a felony conviction or misdemeanor conviction or deferred adjudication for any
of the following offenses, subject to the results of any review process, shall be grounds for
denial of the Rental Application:
Felony convictions involving: murder, manslaughter, arson, rape, kidnapping, child sex
crimes, or manufacturing or distribution of a controlled substance.
Felony convictions not listed above involving: drug related crime; person crime; sex
offense; crime involving financial fraud, including identity theft and forgery; or any other
crime if the conduct for which applicant was convicted is of a nature that would adversely
affect property of the landlord or a tenant or the health, safety or right of peaceful
enjoyment of the premises of the residents, the landlord or the landlord's agent, where
the date of disposition has occurred in the last 7 years.
Misdemeanor convictions involving: drug related crimes, person crimes, sex offenses,
domestic violence, violation of a restraining order, stalking, weapons, criminal
impersonation, possession of burglary tools, financial fraud crimes, where the date of
disposition has occurred in the last 5 years.
Misdemeanor convictions not listed above involving: theft, criminal trespass, criminal
mischief, property crimes or any other crime if the conduct for which applicant was
convicted is of a nature that would adversely affect property of the landlord or a tenant or
the health , safety or right of peaceful enjoyment of the premises of the residents, the
landlord, the landlord's agent, where the date of disposition has occurred in the last 3
years.
Conviction of any crime that requires lifetime registration as a sex offender, or for which
applicant is currently registered as a sex offender, will result in denial.
Individuals are welcome to provide supplemental evidence to mitigate potentially
negative screening results. Individuals have 14 days to appeal denied applications,
during which time they may correct, refute, or explain negative information forming the
basis for the denial.
Screening criteria will be applied uniformly and, in a manner, consistent with all applicable law,
including state and federal Fair Housing Acts
Landlord has a non-discrimination policy as required by federal, state, or local law and does not
discriminate against any applicant because of the race, color, religion, sex, sexual orientation,
gender identity, gender expression, national origin, marital status, or familial status.
